If your request to continue/postpone your hearing is denied, or you are not prepared enough, you can ask to withdraw from the hearing “without prejudice.” This means your withdrawal from the fair hearing will not affect your right to appeal the issue later. It is better to withdraw without prejudice than go to the hearing unprepared. OAH says you must fill out the Notification of Resolution form.
